Murder charge dropped against Milton man who killed intruder during home invasion

Second-degree murder charges against a Milton man were withdrawn during a court appearance this morning, July 31.

Ali Mian, 22, was charged following an alleged home invasion at the house he lived in with his mother on Feb. 19 on Gibson Cres., near Ontario St. S. and Louis St. Laurent Ave.

According to Halton police reports at the time, Mian shot and killed Romario Clarke, 20, during the incident. Another man was arrested at the scene while three others fled.

Mian was immediately taken into custody at the scene and charged with second-degree murder. His lawyer, Toronto’s Jag Virk, said at the time Mian is a registered gun owner who was only defending his mother during a break-in attempt.

“My 22-year-old client, who lives at that home with his single mother, shot at an intruder who broke into his home and attacked his mother,” said Virk about Ali Mian, who is facing a second-degree murder charge.

“He is a registered firearm owner and used his gun legally against an armed intruder. He shouldn’t be charged with murder for protecting his mother from someone who broke into his home. His intention was not to kill the intruder, he only shot at him once.”

The intruder who died at the scene was identified as 21-year-old Alexander Amoroso-Leacock of Toronto.
